This data privacy notice applies to Personal Data provided to or collected by Kubota in relation to the Terrako e-commerce website https://terrako.com/, being a marketplace where products, software and services are sold to dealers and end-customers (hereinafter referred to as the “Website”). The Website may provide links to other websites for your convenience and information. These websites may operate independently from Kubota. Linked websites may have their own data privacy notices or policies, which We strongly suggest you review if you visit any linked websites. To the extent any linked websites you visit are not owned or controlled by Kubota, We are not responsible for the websites’ content (including cookies used on that website), any use of the websites, or the privacy practices of linked websites.

Kubota collects and Kubota, Kubota Holdings Europe or Kubota Corporation might process your Personal Data according to the GDPR or the UK GDPR when you interact with Us and purchase Our products, software and/or services, including while using the Website.

 

The Website enables you to purchase products, software and services of the Brands, as well as other third-party products either directly from Us or from third-parties authorized to use the Website, including Our Dealer network and other Kubota entities, as listed in Appendix 1 (hereinafter referred to as "Sales Partners").

 

We receive Personal Data directly from you, when you visit the Website, create an account and fill in your Personal Data or when you reach out to Kubota customer service through the form on the Website.

 

The legal basis for Kubota’s processing your Personal Data is Kubota’s legitimate interest as per the Article 6(1)(f) of the GDPR, in order:

-        the successful technical provision of the Website, the IT security and its continued optimisation by utilising user Personal Data,

●      CONTROLLER OF YOUR PERSONAL DATA

 

The data controller for your information is Kubota Europe.

 

In addition to the above, your Personal Data might be shared, for the purpose of storage of Personal Data, with Kubota Holdings Europe and/or Kubota Corporation.

 

Insofar as We are acting in the role of the data processor on your behalf, a Data Processing Addendum, governing the processing activities, processed Personal Data, retention and other information such as technical and organizational measures applicable, shall be concluded by and between Us, acting as data processor, and, you, acting as data controller.

 

●      RETENTION OF YOUR PERSONAL DATA

 

Kubota will retain Personal Data no longer than is permitted under applicable data protection laws.

 

The applicable Personal Data retention period may vary per Personal Data category. The criteria on which Our retention policy is based are:

-        the necessity to retain Personal Data in light of the purpose for which they have been collected

-        for order data, We will keep your Personal Data for as long as necessary (up to 10 years) for compliance and requirements with applicable Personal Data retention obligations under mandatory law (such as financial or tax regulations)

-        for marketing purposes, if you have given your consent to Us, We will process your Personal Data for the duration of your consent or until your consent is revoked by you. You can unsubscribe from marketing communications at any time with the effect for the future by emailing khe_g.privacy@kubota.com

-        for the relevance of Personal Data in light of pending or potential legal proceedings; and

-        applicable limitation periods under civil law.

 

We may share your Personal Data to Kubota Holdings Europe and/or Kubota Corporation as long as your user account to the Website is active. We may retain the transaction Personal Data as long as necessary to perform the purposes set out in this data privacy notice and to protect Us from legal claims, or to administer Our business. If We have seen your account has not been active for 2 years, We will automatically delete your account due to the inactiveness and We will assume that you no longer wish to keep your account with Us.

●      STORAGE AND INTERNATIONAL TRANSFERS OF PERSONAL DATA

 

The Personal Data We collect from you is stored in the European Union by Us or Our trusted service providers.

 

However, We may, at any moment, transfer, access from and store the Personal Data collected about you to recipients in countries other than the country in which the information was originally collected. Please note that Kubota goes through a detailed due diligence process before selecting the data processors with whom your Personal Data are shared.

 

In the context of intra-group day-to-day business, We may transfer Personal Data to Kubota Holdings Europe and/or Kubota Corporation. Japan is recognized by the European Commission as offering an equivalent level of Personal Data protection as the European Economic Area.

 

Insofar Personal Data is transferred to receivers located in the United States of America, Kubota has entered into so-called Standard Contractual Clauses (approved by the European Commission) with such receivers for the purpose of compliance with European data protection laws.

 

●      YOUR RIGHTS AND CHOICES

 

You have certain rights regarding the Personal Data We maintain about you. We also offer you certain choices about what Personal Data We collect from you, how We use that information, and how We communicate with you. In accordance with the applicable laws, it is your right to:

If you provide Us with any Personal Data or material relating to another individual, you should make sure that the sharing with Us and Our further use as described to you from time to time is in line with applicable laws, so for example you should duly inform that individual on the processing of her/his Personal Data and obtain her/his consent, as may be necessary under applicable laws.

 

We do not knowingly collect personally identifiable Personal Data from or market to children under the age of 18 years old. If a child under the age of 16 has provided Personal Data to Us through the Website, a parent or guardian may contact Us to request the Personal Data be deleted from Our records. Following receipt of such a request, We will make reasonable efforts to delete the child’s Personal Data from Our records.

Within Kubota, Kubota Holdings Europe or Kubota Corporation, only those who need access to your Personal Data to carry out their activities will have access to your Personal Data and only to the extent necessary to carry out the processing activities as set out in this data privacy notice.

 

We may share your Personal Data with the following parties:

 

●      Sales Partners: when you place an order with our Sales Partners, the Sales Partner will receive your company name (if applicable), delivery address, order details, company Chamber of Commerce number, telephone number. The Sales Partner needs this information to be able to execute the contract that you have entered with them based on their terms and conditions. The Sales Partner will contact you for you to receive your order. If you have filled in the “Contact Us” form on the Website, and the question needs to be forwarded to the Sales Partner, they will contact you to resolve any issues you may have pertaining to your order with them.

 

●      Sales Partners that use the Website for payment: you are able to use the check out option through the Website with some of our Sales Partners. If you use this, We share certain Personal Data with the Sales Partner, so you can use the check out option and the Sales Partner will then receive the Personal Data required to execute the purchase you have made with them. This concerns your company name (if applicable), name, invoice, email address, telephone number. The Sales Partner will take the payment to execute the terms and conditions and the contract between you and the Sales Partner. They will ensure that you are able to receive your order.   

 

●      Software provider: when you purchase a software licence, We will pass on your order details including your personal information, so that the software provider can email you your software licence access key.

 

●      Kubota’s affiliates and parent companies: your Personal Data may be shared with Kubota Holdings Europe and/or Kubota Corporation, and their wholly owned affiliates and/or subsidiaries, as necessary to provide you with the Website as well as for the other purposes described in this data privacy notice. Kubota, Kubota Holdings Europe or Kubota Corporation may access and use the Personal Data in anonymized and aggregated form for statistical purposes as well as to improve or enhance the Website provided under the terms of use, develop additional or new improvements to the Website.

 

●      Trusted suppliers: your Personal Data may be shared with trusted Kubota, Kubota Holdings Europe or Kubota Corporation suppliers as necessary to provide you with the Website.
