In addition to the above, your Personal Data might be shared, for the purpose of storage of Personal Data, with Kubota Holdings Europe and/or Kubota Corporation.

 

Insofar as We are acting in the role of the data processor on your behalf, a Data Processing Addendum, governing the processing activities, processed Personal Data, retention and other information such as technical and organizational measures applicable, shall be concluded by and between Us, acting as data processor, and, you, acting as data controller.

 

      RETENTION OF YOUR PERSONAL DATA

 

Kubota will retain Personal Data no longer than is permitted under applicable data protection laws.

 

The applicable Personal Data retention period may vary per Personal Data category. The criteria on which Our retention policy is based are:

-        the necessity to retain Personal Data in light of the purpose for which they have been collected

-        for order data, We will keep your Personal Data for as long as necessary (up to 10 years) for compliance and requirements with applicable Personal Data retention obligations under mandatory law (such as financial or tax regulations)

-        for marketing purposes, if you have given your consent to Us, We will process your Personal Data for the duration of your consent or until your consent is revoked by you. We may share your Personal Data to Kubota Holdings Europe and/or Kubota Corporation as long as your user account to the Website is active. We may retain the transaction Personal Data as long as necessary to perform the purposes set out in this data privacy notice and to protect Us from legal claims, or to administer Our business. If We have seen your account has not been active for 2 years, We will automatically delete your account due to the inactiveness and We will assume that you no longer wish to keep your account with Us.

Insofar Personal Data is transferred to receivers located in the United States of America, Kubota has entered into so-called Standard Contractual Clauses (approved by the European Commission) with such receivers for the purpose of compliance with European data protection laws.

We may share your Personal Data with the following parties:

 

      Sales Partners: when you place an order with our Sales Partners, the Sales Partner will receive your company name (if applicable), delivery address, order details, company Chamber of Commerce number, telephone number. The Sales Partner needs this information to be able to execute the contract that you have entered with them based on their terms and conditions. The Sales Partner will contact you for you to receive your order. If you have filled in the “Contact Us” form on the Website, and the question needs to be forwarded to the Sales Partner, they will contact you to resolve any issues you may have pertaining to your order with them.

 

      Sales Partners that use the Website for payment: you are able to use the check out option through the Website with some of our Sales Partners. If you use this, We share certain Personal Data with the Sales Partner, so you can use the check out option and the Sales Partner will then receive the Personal Data required to execute the purchase you have made with them. This concerns your company name (if applicable), name, invoice, email address, telephone number. The Sales Partner will take the payment to execute the terms and conditions and the contract between you and the Sales Partner. They will ensure that you are able to receive your order.   

 

      Software provider: when you purchase a software licence, We will pass on your order details including your personal information, so that the software provider can email you your software licence access key.

 

      Kubota’s affiliates and parent companies: your Personal Data may be shared with Kubota Holdings Europe and/or Kubota Corporation, and their wholly owned affiliates and/or subsidiaries, as necessary to provide you with the Website as well as for the other purposes described in this data privacy notice. Kubota, Kubota Holdings Europe or Kubota Corporation may access and use the Personal Data in anonymized and aggregated form for statistical purposes as well as to improve or enhance the Website provided under the terms of use, develop additional or new improvements to the Website.
